(Zoning Ordinance)

 

 

An ordinance of the Town Council of the Town of Rockville, UT, amending the Town of Rockville Zoning Ordinance, hereafter known as the Rockville Land Use Code, relating to the use, dimension and configuration of land within the Town of Rockville.

 

Preamble

 

In order to provide for the health, safety and general welfare of the citizens of Rockville, UT, the Town Council is committed to establish a zoning ordinance intended to help implement the Town of Rockville General Plan relating to land use, residential, commercial, open space, and agricultural site planning, and environmental and community concerns.

 

            WHEREAS, the Town desires to amend the zoning ordinance to be known as the Town of Rockville Land Use Code; and

 

            WHEREAS, the Town Council is authorized to adopt or amend the zoning ordinance; and

 

            WHEREAS, the Zoning Ordinance may address issues, among others, related to land use, sensitive lands, site planning, and community concerns; and

 

            WHEREAS, the Planning Commission has held several publicly noticed meetings in part to discuss the provisions of the Zoning Ordinance; and

 

            WHEREAS, Utah State Code, Sections 10-9-401 through 10-9-408, set forth procedures for the adoption and content of a zoning ordinance; and

 

            WHEREAS, the Town of Rockville Planning Commission made a recommendation, after a public hearing, to the Town Council to adopt this Zoning Ordinance; and

 

            WHEREAS, the Town Council of the Town of Rockville held a duly advertised and noticed public hearing for the purpose of receiving public comment regarding the content of the Zoning Ordinance;

 

            NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Rockville, Utah, as follows:

 

Any existing ordinances covering zoning, in their entirety and including the maps heretofore adopted and made a part of said ordinances are hereby superceded and amended to read as set forth herein.  Not withstanding such prior ordinance’s suspension, this new Ordinance, including the attached maps, shall be deemed a continuation of previous ordinances and not a new enactment, insofar as the substance of revisions of previous ordinances is included in this new Ordinance.  This shall be so whether the language is the same or in different language.  This Ordinance shall be so interpreted upon all questions of construction relating to tenure of officers and boards established by previous ordinances.  The questions of conforming or nonconforming uses and buildings and structures, and questions as to the dates upon which such existing uses, buildings, or structures became conforming or nonconforming shall also be deemed reviewed under the language of the prior ordinance.
